Understanding administrative deadlines and your obligations in Spain
Certain procedures, such as those related to additional services, are entirely subject to Spanish authorities, over which we have no control or leverage.
For example, for a tourist license application, once the file has been submitted, its processing depends exclusively on the relevant town hall. We have no way of influencing deadlines or speeding up the administrative process. It is therefore important to be patient, as the validation of the file depends on the rhythm of the local administration.
Incessant reminders will have no effect, as these administrations process files on a first-come, first-served basis, and may be subject to delays, particularly during certain periods.
Steps after signing at the notary’s office
When you sign the deed of sale at the notary’s office, he or she will give you a simple copy of the signed deed.
This will help you with all the administrative formalities involved in buying your property in Spain.
Then, several steps are necessary to officially register the property in your name:
- Paying taxes
Depending on the type of property (new or old), you will have to pay the corresponding taxes, such as VAT, transfer duties or registration fees.
- Land Registry
Once the taxes have been paid, the deed is sent to the Property Registry (Registro de la Propiedad) to officially register the property in your name.
- Delivery of the final deed
After registration, which may take several months, you will receive the registered deed, i.e. the final title to the property.
We would like to remind you that we are totally dependent on the Spanish State to issue the final authentic deeds, and there is no way of speeding up this administrative process.
If you’ve bought with a bank loan, it’s often the bank or the notary’s manager who takes care of everything.
Your administrative and tax obligations in Spain
As a property owner in Spain, whether you live there or not, you have a number of tax and administrative obligations to meet.
1. Non-resident tax returns :
Income tax for non-residents with a non-rented property (personal use or other) – Impuesto sobre la Renta de No Residentes (IRNR) Impuesto sobre la Renta de No Residentes (IRNR)
Even if you don’t live in Spain, you’re still required to complete a compulsory annual property tax return. Even if you don’t generate rental income, you must declare a lump-sum income linked to the ownership of the property in Spain.
- For a couple, a declaration must be made for each spouse, i.e. 2 declarations per year.
- This amount is generally low and does not exceed €200 per year.
Impuesto sobre la Renta de No Residentes (IRNR) – income tax for non-residents with a rented property (generating rental income) :
If the property is rented out, the non-resident owner must declare rental income each year via this tax.
This income will be subject to non-resident income tax, at a rate of 24% for non-EU residents and 19% for EU residents, with the possibility of deducting charges inherent to the property (management fees, taxes, repairs, etc.).
Please note: If you are a couple, you will need to complete one declaration per spouse, i.e. two declarations per year.

2. Property tax – Impuesto sobre Bienes Inmuebles (IBI) & Municipal garbage service :
In Spain, two distinct local obligations apply to homeowners:
- Property tax (Impuesto sobre Bienes Inmuebles – IBI)
- Municipal waste management service (garbage can service)
Both are managed by the local council and require updating after a property purchase, inheritance or change of ownership.
The amount of the IBI is based on the cadastral value of the property, while the garbage service may be billed separately depending on the commune.
We strongly recommend that you direct payments directly to the municipality concerned, to avoid any oversights, reminders or penalties.
How to proceed?
- Obtaining the digital certificate :
A digital certificate in Spain is an official electronic document that enables you to prove your identity securely when interacting with public administrations.
This certificate is essential for carrying out certain tax and administrative procedures in Spain, signing documents electronically, accessing administrative services and carrying out tax and legal procedures online.
Our after-sales service can also help you obtain this digital certificate, valid for one year, to simplify the management of your tax obligations.
- Change of property tax holder (IBI) :
Once you’ve received your digital certificate, we’ll be able to change the holder of your property tax (IBI) and the bank direct debit via our dedicated service.
Please note: Without the digital certificate, this procedure cannot be carried out.
- Change of owner of the municipal waste collection service:
We also update the holder’s bank account and direct debit for municipal waste management. via our dedicated service.
This is independent of the property tax, but just as essential to ensure continuity of service.
